Ebabee.co.uk's Termination Rights.
You agree that ebabee.co.uk, in its sole discretion, may terminate any listing or use of the service immediately and without notice if (a) ebabee.co.uk believes that you have acted inconsistently with the spirit of this Terms of Service or (b) if ebabee.co.uk believes you have contravened or tried to contravene the rights of other users.

Your Conduct.
You are solely responsible for the contents of your transmissions through our service. You must ensure that your participation in the selling or buying of items does not contravene any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation. In particular, you may not sell or buy property which requires a written contract, which is illegal, which requires a licence to buy or sell (for instance firearms, alcohol or pharmaceutical drugs) or which requires you to obtain an export licence.

You must not transmit through the service any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.

If either you or we terminate your membership, you will continue to owe us any money which you owed to us before termination.

ebabee.co.uk prohibits the use of another internet service to send or post spam to drive visitors to your site hosted on or through the ebabee.co.uk system, whether or not the messages were originated by you, under your direction of a related or unrelated third party.

Eligibility for Membership.
Our services are available only to individuals who can form legally binding contracts under applicable law. We require your full address and telephone number contact information on registration. Without limiting the foregoing, our services are not available to minors. If you do not qualify, please do not use our services.

Members can not hold ebabee.co.uk responsible for loss of data, profit, earnings or damage.

Eligibility to become a seller
A member may become a seller at any point. Ebabee.co.uk requires a payment of 50p in order to verify your location. This is to try and keep fraud to a minimum. Once we have established your registered information matches a. the information from paypal or b. your security number we sent to the registered address. Your seller account will become active.

Ebabee.co.uk has the right to close your account at anytime with or without notice.

Ebabee.co.uk will complete a regular seller review to maintain our records with the most up to date information about you. If we complete a review on your account and you fail to provide us with the relevant information we can suspend your account. It you your responsibility to provide us with the most up to date information at all times.

Sellers are able to go to a maximum of £6.00 in arrears before their seller ability is frozen. Once account has been brought back into credit you can start selling again.

A seller must pay any owed monies to ebabee.co.uk when requested. Failure to do so may result in your debt being sold to an external collection agency no matter how much is owed.

An invoice will always be sent to the registered email address and internal email account. We will always retain copies of these in case needed in a court of law.

You agree that the buyer is allowed to see your name, address, and contact information on the provided invoice when an item has been purchased! **If you do not agree to this please close this page and do not complete the registration process. Only the buyer of an item will see this personal information.

Ebabee.co.uk is only an arena.
Please consider using ESCROW!
Our site acts as the arena for sellers to conduct transactions and for bidders to bid on sellers' listings. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items advertised the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on. In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence. Ebabee.co.uk strongly recommends using escrow for all transactions to ensure safety.

You give us a non-exclusive, worldwide, royalty-free, irrevocable, sublicenseable (through multiple tiers) right to exercise all copyright and publicity rights, in any existing or future media, known or unknown, over the material or User Data displayed in Your listings or bids. For the purpose of this Agreement, "User Data" shall mean all information (if any) submitted by you, (the "User") to ebabee.co.uk with the exception of credit card numbers, bank account numbers etc.

No Resale or Unauthorised commercial use of the service. You agree not to make any unauthorised commercial use of the service without express written consent of ebabee.co.uk.
Ebabee.co.uk makes no warranty that the service will meet your requirements, or that the service will be uninterrupted, timely, secure, or entirely error free. We do not make any warranty as to the results that may be obtained from the use of the service or as to the accuracy or reliability of any information provided by sellers or buyers and obtained through the service. We will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise), even if that loss or damage was foreseeable by, or the possibility of it was brought to the attention of, ebabee.co.uk.
We reserve the right to provide counterparties with information pertaining to a complaint or statement, written or oral, made against them by you or third-party acting with or without your consent. Because we do not and cannot be involved in user-to-user dealings, in the event that you have a dispute with one or more users, you release ebabee.co.uk (and our agents and employees) from claims, demands and damages (actual and consequential) of every kind and nature, know and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

User agrees that ebabee.co.uk shall not be responsible or liable to user, or anyone for the statements or conduct of any third party on the service.

No advice or information, whether oral or written, obtained by user from ebabee.co.uk or through or from the service shall create any warranty not expressly stated herein.

You agree that use of the service is at user's sole risk. The service is provided on an "as is" and an "as available" basis.

You must reimburse us for any loss, cost or expense which we suffer if someone else makes a claim against us as consequence of the use of the service by you or by someone else from your computer.

Ebabee.co.uk shall not be responsible for any items sold by Classified, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. Ebabee.co.uk shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.

Ebabee.co.uk assumes no liability for the content of the listings. The seller shall reimburse ebabee.co.uk for all losses ebabee.co.uk may suffer as a result of the listing, unless that loss is due to ebabee.co.uk's act or omission.

The right to sell items through our service is subject to the relevant fees. These fees are to be paid on request of ebabee.co.uk. Failure to make payments may lead to your debt being passed to an external collection agency no matter how much is owed!.

Ebabee.co.uk has the right without notice to remove any listings that are not of our audience nature (baby / children related). Any listing that does not comply with the law will be removed, and in certain situations details of the member may be passed the the local authority.

Only one account per person is allowed. If ebabee.co.uk find that a member has more than one account active, we have the right to suspend either if not all accounts relating to that member without notice. If this is the situation, any outstanding monies owed to ebabee.co.uk must be cleared.

Modification to the service.
We reserve the right to modify or discontinue the service if there is a change in the law or our operational requirements. We will not be liable to you for any loss you may suffer if we have to modify or cease the service for reasons beyond our control if we give you at least 30 days notice. In certain exceptional circumstances beyond our control we may have to change or discontinue the service without giving you this amount of notice. If this is the case we will give you as much notice as we can.

If you do not wish to use the new operating rules or policies you should not continue to use the service after the notice requirement.

Laws.
These Terms of Service shall be governed by and constructed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.

Our Promise
Ebabee.co.uk will always try and bring buyers and sellers a top quality service. We can not always guarantee 100% uptime. Unfortunately this is down to many factors outside of our control. We can not be held liable for any downtime that may occur at the time of an item ending.

Ebabee.co.uk will always try and help solve a dispute between two members.

Once a buyer has purchased an item, the buyer and seller are displayed with the opposites contact information this is not a breach of data protection.

Ebabee.co.uk will always keep records of all contact details a member has had, this will allow us to find a member in the case of fraud or for lawful information.

We will keep our prices as low as possible. Ebabee.co.uk have the right to raise prices but not without 30 days notice via email.

Add new features regular with a trial period before charging any fees!. After a 30 day period we have the right to charge fees for the new feature.

Ebabee.co.uk will NEVER share your contact details with any other company.

Ebabee.co.uk uses a unique email safety feature consisting on showing you, your favourite colour, security number and mother maiden name. This is to stamp out spoof email. If you do get an email with incorrect security information. Please notify us at once! Ebabee.co.uk can not be held responsible for any spoof email received.

If you do get a spoof email and navigate via it giving your username and password. It is in your best interest to notify us at once. You are liable for any fees acquired until you have notified us. If listings have been created and are live we can remove these listings and reimburse fees. If the listing has ended or is sold unfortunately ebabee.co.uk can not reimburse fees.
